Privacy Policy
This Privacy Policy explains how KIVN ("KIVN," "we," "us," or "our") collects, uses, and discloses information in connection with the KIVN website and services (the "Services"). By using the Services, you agree to the practices described in this Policy.
1. Information We Collect
Information you provide to us. When you create an account, we collect your email address and password. When you subscribe to a paid membership, request a custom plan, or communicate with a coach, we collect the information you choose to provide, which may include your goals, training schedule, and other details relevant to your programming. We also retain the content of messages you send to us.
Payment information. Payments for paid memberships are processed by our payment processor. We do not collect or store your full payment card number. The payment processor handles your card information directly, and we receive only limited information such as your subscription status and the last four digits of your card.
Email information. When you join our email list, we store your email address with our email provider so we can send you programs and updates.
Information collected automatically. When you use the Services, certain information may be collected automatically, including your internet protocol address, browser type, device information, and pages viewed. We use this information to operate, secure, and improve the Services.
2. How We Use Your Information
We use the information we collect to provide and operate the Services, including accounts and memberships; to process payments and manage your subscription; to deliver the programs, coaching, and support you request; to send you communications you have requested; to respond to your inquiries; to maintain the security of the Services and prevent fraud or misuse; and to comply with our legal obligations. We do not sell your personal information.
3. How We Disclose Your Information
We disclose information only as necessary to operate the Services, including to service providers that process information on our behalf, such as our payment processor, authentication and database provider, email provider, and hosting provider. These providers are permitted to use your information only to provide services to us. We may also disclose information when required by law or legal process, or where we believe disclosure is necessary to protect the rights, safety, or property of KIVN, our users, or others. If KIVN is involved in a merger, acquisition, or sale of assets, we may transfer your information as part of that transaction.
4. Data Retention
We retain your information for as long as your account remains active or as needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account and associated information as described below.
5. Your Rights and Choices
You may unsubscribe from marketing emails at any time using the link provided in each email. You may update or request deletion of your account by contacting us at epolster38@gmail.com. Depending on your place of residence, you may have additional rights under applicable law, including the right to access, correct, or delete your personal information, or to object to or restrict certain uses of it. Residents of California and certain other states may have specific rights under state privacy laws, including the right to know what personal information we collect and to request its deletion, without discrimination for exercising those rights. To exercise any of these rights, please contact us at epolster38@gmail.com, and we will respond as required by applicable law.
6. Security
We use reasonable administrative and technical safeguards and rely on the security measures of our service providers to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. Children's Privacy
The Services are intended for adults who are at least eighteen years of age. We do not knowingly collect personal information from children. If you believe that a child has provided us with personal information, please contact us, and we will take appropriate steps to delete it.
8. Cookies and Similar Technologies
We and our service providers may use cookies and similar technologies to keep you signed in, remember your preferences, and understand how you use the Services. You can manage cookies through your browser settings. If we introduce analytics or advertising technologies in the future, we will update this Policy and provide any notice or consent mechanism required by law.
9. Third Party Links and Content
The Services may contain links to third-party websites or embed third-party content, such as videos. We are not responsible for the privacy practices of any third party, and we encourage you to review their policies.
10. International Users
We operate in the United States. If you access the Services from outside the United States, we may process your information in the United States, where data protection laws may differ from those of your country.
11. Changes to This Policy
We may update this Policy from time to time. When we do, we will post the revised Policy with an updated "Last updated" date. By continuing to use the Services after the revised Policy takes effect, you accept the changes.
